Questions:
  • Is the ברייתא discussing the ערי מקלט or the ערי לויה ?
  • If the population of the ערי מקלט decreased the ברייתא says we need to import כהנים, לוים, וישראלים. Whats the need for these three classifications of people? ריטב”א , ערוך לנר
  • Why do we need to send the רבי of the רוצח  to גלות, can’t we just have a great תלמיד חכם in גלות that would teach him תורה? Important ריטב”א “מגלין
  • Why is a persons רבי considered the רוצח livelihood? Very important  רמב”ם ה’ רוצח ז,א
  • If a רבי is sent to גלות the ישיבה is sent along with him.  Is this true as well when the רבי has to go to גלות because his תלמיד was sent to גלות? See ערוך לנר “מגלין

Questions;
  • Why is a סומא exempt from גלות?  See רמב”ם ה’ רוצח ו,יד
  • If רבי יהודה is using “בבלי דעת” to exclude מתכוין then it is still a מיעוט אחר מיעוט which should include a סומא for going to גלות?
Major question:  There are two elements to the concept that a person needs התראה .
  • 1. To determine the crime was committed intentionally.  2. To warn the person of the punishment he is culpable for committing this crime.  How could ר’ יוסי hold the שונא is חייב מיתה even though we take for granted he murdered intentionally but who says the שונא knows the severity of the punishment for murder? ריטב”א ו: ” דתניא
Point to ponder:
  • Does the תנא קמא disagree with ר’ שמעון? and if so why? ערוך לנר, רש”ש, תוס’ ב. “מעידין” .. אבל קשה

Quickly review גמרא ט עמוד א from bottom of עמוד until משנה עמוד ב.

Learn מהרש”א “ממך למד that explains the word ממך – from you, is misleading & what the גמרא really means is “from him (אברהם אבינו)”.  The מהרש”א also gives an additional explanation which is more grammatically correct with the definition of the word ממך.
Learn משנה ט עמוד ב and the גמרא until the first wide line.
  • Point to ponder: Why is a סומא exempt from גלות?
  • Question; If רבי יהודה is using “בבלי דעת” to exclude מתכוין then it is still a מיעוט אחר מיעוט which should be used to include סומא?
