We discussed the machlokes between Rashi and Tosfos why דמאי is considered יש בה היתר אכילה
whether we need the logic of one being able to be מפקיר all his possessions in order to use an Esrog of דמאי.
According to “תוספת “דאי – because can feed the דמאי to poor people and soldiers stationed in their town.
According to Rashi (based on רש”י דף לד: “האי יש בה) because one has the ability to eat דמאי by making all his possessions ownerless.

Very quickly review last : משנה כב

Questions:
  • Why is the מלקה exempt when the נלקה dies due to the lashes? (See רש”י ח.  “ושליח ב”ד)
  • When the מלקה adds an extra lash resulting in the death of the נלקה the  מלקה go to גלות. Why? גלות is only for an accident, and this is negligence? (See ריבן , ריטב”א )  (Extra See רמב”ם רוצח ה,ו & ה’ ראב”ד

Questions:
  • What is the case of מבזה המועדים ? (See רש”י, רמב”ם ה’ יו”ט ו, טז-יז )

Very quickly review :גמרא כב from second set of two dots until the משנה.

Questions:

According to the ריב”ן

  • What is the חילק between being reevaluated on the same day as the first evaluation or on a later date?
  • Why does the נלקה not need to endure his full share of lashes if there was an underestimation in the original evaluation ?
  • Why does the נלקה not need to endure his full share of lashes when the reevaluation is done on a later date and its clear he can endure the full amount contrary to the original evaluation which said he can only endure part of the 39?

Continue learning the משנה and גמרא including the second משנה until the bottom of the עמוד

Point to ponder:
  • When the נלקה is evaluated that he can endure 42 lashes we consider it as getting 2 sets if lashes.
  • Is this only for one action that is a violation of 2 לאוין or even for 2 individual violations of 2 לאוין ?  See ערל”נ

Questions:

  • Why does the חזן  rip the shirt of the נלקה ? See ריטב”א
  • When the מלקה adds an extra lash resulting in the death of the נלקה the  מלקה go to גלות. Why? גלות. Is only for an accident? This is negligence? (See ריבן , ריטב”א )

The ראשונים seem to give an entirely different reason then the גמרא
why we only give 39 lashes when the תורה says 40 (See ריטב”א , and רמב”ם ה’ סנהדרין י”ז,א )

Questions:

  • How can they give a different reason then the גמרא?
  • What is a נפקא מיניה between the explanations? (See “ערוך לנר “בצרו )
  • Why does רש”י דברים כ”ה,ג give a different explanation then the גמרא ?

Learn .גמרא כב  from “אמר רב הושעיא ” (three lines before the משנה) until the משנה

Question:
  • What is the כלאים in the case of שור פסולי מוקדשין ? (Three explanations ריב”ן “המרביע”, תוס’ ” שהרי”, ריטב”א “אמר )

The גמרא explains why we only give 39 lashes when the תורה says 40 from the way the תורה writes the order of the words in the פסוק.
Learn the ראשונים who seem to give an entirely different reason then the גמרא
