Question:
According to the ריב”ן
  • What is the חילק between being reevaluated on the same day as the first evaluation or on a later date?
  • Why does the נלקה not need to endure his full share of lashes if there was an underestimation in the original evaluation ?
  • Why does the נלקה not need to endure his full share of lashes when the reevaluation is done on a later date and its clear he can endure the full amount contrary to the original evaluation which said he can only endure part of the 39?
Point to ponder:
  • According to רבי יהודה when the נלקה can only endure part of the 39 lashes would he still receive one or more lashes בין כתיפיו?
  • According to רבי יהודה when the נלקה can only endure 20 lashes, will he receive 2 lashes בין כתיפיו?  (The ערל”נ “דכתיב” and “אשר” discusses these two questions)

The gemara says that saying bris and torah in the second bracha of benching is required. If one forgets bris and torah, is he required to repeat benching? See Biur Halacha siman 187 sif 3 dh machzirin. See also Ritva here on 49a dh vehamilah that discusses this. If one finished the second bracha of benching without bris and torah and realized his mistake before beginning the next bracha, what should he do now? See Shaar Hatzion on the bottom of the Mishna Brura siman 187 sk 8. Is there room to take issue with his proof from yaleh veyavoh?

The ראשונים seem to give an entirely different reason then the גמרא
why we only give 39 lashes when the תורה says 40 (See ריטב”א , and רמב”ם ה’ סנהדרין י”ז,א )

  • How can they give a different reason then the גמרא?
  • What is a נפקא מיניה between the explanations? (See “ערוך לנר “בצרו )
  • Why does רש”י דברים כ”ה,ג give a different explanation then the גמרא ?
