Rabbi Baruch Bodenheim: Thursday Night Mishmar: Why Succos Is After Yom Kippur (09/27/2012)
Learn Gemara 32a “Mitzva Min .. ” (first big wide line) until end of the Amud.
Fundamental Questions; What is the Chidush of the Torah writing the obligation to help both load & unload someones animal. Is the Chidush that one can charge for loading, or that the unloading has to be done for free? Learn Rashi “Lomar” very well. Tosfos 31a “Lamah” (Maharsha on Rashi “Lomar”)
How do we calculate the payment for loading? As a day laborer, or a Poel batel? Rosh Siman 28, Nimukei Yosef pg 17b of the Rif “Lifrok Bchinum”
Learn Gemara 31b “Tana Nosen ..” (2 dots on the 2nd wide line)
In the conclusion of the Gemara what is the calculation of the payment of a “Poel Batul”?
Fundamental Question; Why can a person who has to stop his work in order to return an Aveida allowed to charge money for the return? Rosh Siman 24, Tosfos 68a “Vnosen” (starting from “Viim Tomar” wide lines at the end of Tosfos)
Continue learning the Gemara until the Mishna 32a
Learn Gemara 31b “Mos Yumas” (top of Amud) until 2 dots on first wide line of Gemara. Questions; The gemara says we have a special Pasuk that one has to return the collateral that was taken by force when the owner needs it. Why would I think the law should be different then if the collateral was taken by the court? Ritva “Mashchenu”, Shita Mekubetzes “Vharabenu Yehonason …”
According to Raban Elazar Ben Azaria the double word of “Havait” is just because the Torah is speaking like regular people. If that’s an acceptable explanation so how can we learn any Drasha from the double words in the Torah? Tosfos “Dibra”
Learn Gemara 31a “Amar lei …” (5 lines into the big wide lines) until 31b “Hashev Tashiv” (10th line from top of Amud)
Questions; The Gemara says on bottom of 31a that one has to help load & unload someone else’s animal because the animal is in pain. Contradiction to Gemara a few lines before that says there is no “Tzar Baalei Chaim” if one refuses to help load someone else’s animal? Ritva 31a “Aval”
The Gemara on top of 31b says a person is only required to help load & unload someone else’s animal if the owner is there. Contradiction to the Gemara 31a which learnt from the double language of the Pasuk that one is required to help load & unload even if the owner is not there? Tofos 31b “Aval”
Learn Gemara 31a from second set of two dots until 3rd to last line on Amud “Lamah”
Question; Why would we think that if one needs the mother bird for a mitzvah that would over ride the mitzvah of Shiloach Hakan? Ritva “Ein”, Tosfos Rosh “Ldvar”
Learn Tosfos “Lamah”
