Review quickly גמרא י: אמר רב הונא (sixth medium line) until אמר ר אלעזר (eight lines before the wide lines.)
- In the משנה דף י”א עמוד ב there’s a מחלוקת whether the גואל הדם has a מצוה or just a רשות to kill the רוצח. How could רב הונא argue on the משנה?
- The רבנן argue on רב הונא and hold that the גואל הדם is חייב מיתה for killing the רוצח. How could they argue on the משנה? Very important ה’ ב”ח אות ב
Important point to clarify: Is the מחלוקת before ב”ד sentenced the רוצח to גלות or after? Bring a proof from the גמרא
- If the מחלוקת is before ב”ד sentenced the רוצח to גלות how could the גואל הדם kill the רוצח maybe the murder was a total freak accident and the רוצח is not even חייב גלות?
- If the מחלוקת is after ב”ד sentenced the רוצח to גלות how could רב הונא hold the גואל הדם is פטור if he kills the רוצח. Don’t we have to give the רוצח the opportunity to run to גלות?
- If the two ת”ח are assigned immediately after the murder how could they tell the גואל הדם that the רוצח only killed בשוגג maybe he killed intentionally?
