Questions on the גמרא we learnt Monday night… מ”ט דר”ע

 Major question: The ‘גמ gave two reasons to explain the opinion of ר”ע. Either גזירה שוה or כדי רשעתו is only referring toרשעה המסורה לב”ד.  But ר”ע himself explains why he makes a difference between חייבי כריתות and חייבי מיתות ב”ד and its not like either explanation of the גמ? See the הגהות הב”ח אות א, on the side of the ‘גמ

  • What is a נפקא מינה להלכה between the two explanations of ר”ע, either גזירה שוה or כדי רשעתו is only referring to רשעה המסורה לב”ד? Learn תוס’ ברשעה

According to רבא there is no dispute between ר”ע and ר ישמעאל of what the punishment will be if the criminal was warned that he will receive both מלקות and מיתה.
