Questions on the גמרא we learnt Monday night… מ”ט דר”ע
Major question: The ‘גמ gave two reasons to explain the opinion of ר”ע. Either גזירה שוה or כדי רשעתו is only referring toרשעה המסורה לב”ד. But ר”ע himself explains why he makes a difference between חייבי כריתות and חייבי מיתות ב”ד and its not like either explanation of the גמ? See the הגהות הב”ח אות א, on the side of the ‘גמ
- What is a נפקא מינה להלכה between the two explanations of ר”ע, either גזירה שוה or כדי רשעתו is only referring to רשעה המסורה לב”ד? Learn תוס’ ברשעה

- What is the difference between רבא and the original explanation of the ‘גמ of the מחלוקת between ר”ע and ר ‘שמעאל?
According to רבא there is no dispute between ר”ע and ר ישמעאל of what the punishment will be if the criminal was warned that he will receive both מלקות and מיתה.
